About the consultation

We’re inviting views from Dartford Borough Council tenants on our updated Tenancy Agreement terms and conditions. We have also developed a new Tenancy Support Pack which contains further information to support our tenants with their tenancy.

Why is the Tenancy Agreement changing?

The existing Tenancy Agreement has been reviewed to ensure it is up-to-date and that it remains effective. The new agreement has considered changes in legislation, and taken into account feedback and issues which have been raised with us by our tenants. An independent legal expert has reviewed the new agreement to make sure all proposed changes are fair and legally sound.

What happens next?

Once the consultation closes, we will look at all comments received and may make further changes to the Tenancy Agreement based on these comments. After this, all tenants will be sent a Preliminary Notice of the Council’s intention to serve a Notice of Variation of their conditions of tenancy. This is in line with sections 102 and 103 of the Housing Act 1985.

There will be another chance for our tenants to put forward any comments once the Preliminary Notice has been received. After we consider this second round of comments, we will then ask for formal approval from our Cabinet to implement the proposed changes. Once this approval has been given, a Notice of Variation will be sent to all tenants, which is when these changes will take place. Tenants will not need to sign another tenancy agreement.
